Welcome to Truffle Homes. These Terms of Use (the “Terms”) govern your access to and use of the Truffle Homes websites, applications, alerts, and related services (collectively, the “Service”) provided by Truffle Homes (“Truffle,” “we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when creating an account and to keep this information updated. Notify us promptly at hello@truffle.homes if you suspect unauthorized use of your account.

3. What Truffle Does

Truffle aggregates and surfaces real estate listings (including, where available, MLS feeds and other publicly accessible sources covering Massachusetts) and provides alerts, search tools, and related features. We do not own the underlying listings and are not a party to any real estate transaction. Truffle is not a real estate brokerage and is not acting as your agent, broker, attorney, or financial advisor.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Scrape, harvest, or otherwise extract data from the Service except as permitted by these Terms;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying systems;
• Resell, sublicense, or commercially exploit the Service or content surfaced through it without our prior written consent;
• Use the Service to harass, defame, discriminate against, or harm any person.

5. Subscriptions, Fees, and Billing

Certain features of the Service require a paid subscription. Pricing, billing intervals, and access levels are described at the point of sale. Subscription fees are billed in advance and are non-refundable except where required by law or expressly stated by us. We reserve the right to change our pricing on prospective renewals with reasonable notice.

6. Listings, Data, and Third-Party Content

Listings, market data, and any information surfaced through the Service are provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any listing or data point. You are solely responsible for verifying any information before acting on it. Some content may originate from third-party sources subject to their own terms.

7. Intellectual Property

The Service, including its software, design, trademarks, and original content, is the property of Truffle or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, used the Service in a way that exposes us or other users to risk, or for any other lawful reason. You may stop using the Service and close your account at any time.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF LISTINGS OR DATA. 10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRUFFLE AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold Truffle harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your breach of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles. Any dispute arising under or relating to these Terms will be resolved exclusively in the state or federal courts located in Suffolk County, Massachusetts, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll revise the “Last updated” date at the top of this page. Material changes will be communicated through the Service or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
